FFMP Negotiations Remain Stalled

May 15, 2015: Despite meeting again late last week, we’re told the Decree Parties failed to achieve any breakthroughs or make any progress on negotiations surrounding the management plan (FFMP) for the NYC Delaware River basin reservoirs.

The state of New Jersey continues to take the position that they will not vote for another one year extension if their demands are not met. If the parties cannot achieve unanimous agreement on a new plan or another extension by May 31, the management of the reservoirs automatically reverts back to an outdated 1980’s approach known as “Revision 1”.

Revision 1 could result in dramatically low water releases, possibly as much as a 90% reduction from FFMP levels from June 1 – June 15 (and low releases throughout the year) which could dewater large swaths of riverbed and have devastating impacts on aquatic habitat and the recreational economy of the UDR region.

The clock is ticking loudly as we rapidly approach the May 31 expiration of the current plan. Look for another update and action alert from us in the coming days.
